COMPANY PRIVACY STATEMENT REGARDING THE PROCESSING OF PERSONAL DATA

 

Marketing Birds Academy (www.academy.themarketingbirds.com), pays strict attention to the security of personal data and the rights arising from that of the clients. As a data controller in the context of our online education services, sales transactions, and other activities, we would like to inform our valued website visitors, members, customers, business partners, goods/service providers, and other relevant parties in accordance with the Law on the Protection of Personal Data and related legislation. The term "personal information/data" mentioned in this privacy statement refers to any kind of information related to an identified or identifiable natural person.

Purpose of Processing Personal Data:

 

Personal data of the data subjects are processed within the framework of the provisions and purposes of Articles 5 and 6 of Law No. 6698 for conducting the necessary activities by the business units of Marketing Birds Academy to benefit the data subjects from online education services and other services provided to them, for conducting the necessary activities by the relevant business units for the realization of the commercial activities carried out by Marketing Birds Academy and the execution of related business processes, for planning and executing the commercial and/or business strategies of Marketing Birds Academy, for ensuring the legal, technical, and commercial security of the individuals and legal entities in the service/business relationship with Marketing Birds Academy, and for planning and executing the activities necessary for customizing the commercial activities and the products and services offered by Marketing Birds Academy according to the preferences, tastes, habits, and needs of the relevant individuals, as well as for offering and promoting them to the relevant individuals, within the framework of the personal data processing conditions and purposes specified in Law No. 6698.

 

Transfer of Personal Data

 

Personal data of the data subjects may be shared with company officials, our business partners, suppliers, legally authorized public institutions and organizations, banks and financial institutions, and other private law natural and legal persons within the scope of our education services, sales transactions, and other services, in accordance with the personal data processing conditions and purposes specified in Article 8 of Law No. 6698, including conducting the necessary activities by the business units of Marketing Birds Academy to benefit the data subjects from online education services and other services provided to them, conducting the necessary activities by the relevant business units for the realization of the commercial activities carried out by Marketing Birds Academy and the execution of related business processes, planning and executing the commercial and/or business strategies of Marketing Birds Academy, ensuring the legal, technical, and commercial security of the individuals and legal entities in the service/business relationship with Marketing Birds Academy, and planning and executing the activities necessary for customizing the commercial activities and the products and services offered by Marketing Birds Academy according to the preferences, usage habits, and needs of the relevant individuals. The data processed by Marketing Birds Academy is not transferred abroad and is not shared with foreign institutions and organizations without the explicit consent of the data subjects.

 

Users' Consent Regarding the Matter

 

In cases specified in Article 5(2) of Law No. 6698, personal data may be processed without the explicit consent of users. Accordingly,

 

a) Explicitly prescribed by laws.

 

b) It is necessary to protect the life or bodily integrity of the data subject or another person in situations where it is impossible to obtain consent or where consent cannot be legally valid.

 

c) It is necessary for the processing of personal data belonging to the parties of a contract, provided that it is directly related to the establishment or performance of a contract.

 

d) It is required for the data controller to fulfill its legal obligations.

 

e) The data subject has made the data public themselves.

 

f) In cases where data processing is necessary for the establishment, exercise, or protection of a right, as long as it does not harm the fundamental rights and freedoms of the data subject, explicit consent from users is not required for the processing of personal data for the legitimate interests of the data controller. The processing of personal data by Marketing Birds Academy mainly falls within these exemptions and particularly falls under the exceptions specified in points (c) and (d) above. Therefore, legally, the explicit consent of the data subjects is not required for the collection of personal data collected within the scope of contracts established for the completion of membership and purchase transactions with our customers and for the performance of other services provided. In exceptional cases not covered by exemptions, data recording is not performed without the explicit consent of the data subject. Personal data of the data subjects are kept and, when the storage period expires, deleted in accordance with our company's personal data retention and destruction policy during the initial destruction period.

 

Method of Collection and Legal Basis for the Collection of Personal Data:

 

Personal data is collected from users electronically entirely by automatic means and/or semi-automatically as part of the data recording system in physical environments. Personal data collected for the reasons mentioned above can be processed for the purposes specified in Articles 5 and 6 of the Law and in this Information Text, and can be transferred in accordance with Article 8 of Law No. 6698.

 

Rights of Users as Personal Data Owners:

 

In accordance with Article 11 of Law No. 6698, data owners have the right to:

 

  • Learn whether personal data concerning them is being processed,

  • Request information if their personal data has been processed,

  • Learn the purpose of processing personal data and whether they are being used in accordance with their purpose, 

  • Know the third parties to whom personal data is transferred, whether domestically or internationally,

  • Request the correction of personal data in case they are incomplete or incorrect and request that the process of correction be notified to third parties to whom the personal data has been transferred,

  • Request the deletion or destruction of personal data in case the reasons requiring processing no longer exist, even though it has been processed in accordance with the Law and other relevant laws, and request that the process of deletion or destruction be notified to third parties to whom the personal data has been transferred,

  • Object to the emergence of a result against themselves through the analysis of processed data exclusively through automated systems,

  • Demand compensation for damages in case personal data is processed unlawfully.
